Change of practice regarding the registration of contract and statement from shipyard about building of a ship

The Ship Registers have in accordance with the Ministry of Industry's assessment, taken for its basis that The Norwegian Maritime Code's regulations do not constitute an impediment for advance registration of building contracts and security in such contracts, when a ship building contract with a Norwegian shipyard has been entered into, in cases where hulls are delivered to the Norwegian shipyard from foreign shipyards, cf. The Norwegian Maritime Code § 31. Legal protection for registered encumbrances in the Norwegian Ship Building Register comprises automatic modules and hulls at the point when these arrive at the Norwegian shipbuilding yard, cf. The Norwegian Maritime Code § 43.
This implies that The Norwegian Maritime Code § 13, 3rd paragraph, cf. § 31, 3rd paragraph, which requires documentation about ownership and deletion certificates from foreign ship building register, does not apply to modules or hulls which are delivered to Norwegian shipyards for completion and registration in the Ship Building Register.
The responsibility for obtaining the above-mentioned documents is incumbent on the parties, and The Ship Registers requests the parties themselves to obtain the documentation they find necessary as regards ownership and security regarding hulls or modules built abroad.

As regards new buildings (ships) from a foreign country that are about to be registered directly in the NOR/NIS, ownership and deletion certificates from foreign ship building register still need to be documented in accordance with The Norwegian Maritime Code § 13, cf. § 15.

The form "Notification to the Shipbuilding Register" has been revised and should be used for new registrations in the Ship Building Register.
